General Terms and Conditions
To SAMBIL EATS Restaurants, Delivery Company and Clients.
1. Definitions
SAMBIL EATS | SAMBIL EATS is a contactless online food ordering platform which gives the customer the opportunity to choose from Take-Out, Curbside and Delivery Service. |
Food & Beverage | food, alcoholic or non-alcoholic beverages offered thru the menus of the participating restaurants. |
SAMBIL EATS | Is an online food ordering platform managed by Spoonity. |
Clients | Any individual that makes use of the Sambil EATS platform for ordering food and/ or beverage. |
Curbside Pickup | Curbside Pickup is a specific designated location in the parking lot of the mall. |
Multiple order | Clients may place more than one (single) order at more than one restaurant located in Sambil Food Court |
2. Sambil EATS
- Sambil EATS platform enables the possibility for individuals to order food and beverage online from restaurants at the Sambil Food Court.
- Sambil EATS platform enables also the opportunity to make orders ahead (till 4 days ahead). So, orders can be placed 24 hours a day.
- Sambil EATS platform does not offer online payment or online bank transfers
- Sambil EATS platform does not offer credit lines with the restaurants.
- Sambil EATS is not responsible for any monetary exchange that involves cash or any other inaccuracy during the transaction process.
- All the prices on Sambil EATS platform menu includes tax (OB) according to the government established tax rates. Sambil EATS offers designated Curbside pickup location(s) at Sambil. However, this location is subject change due to weather conditions.
- Sambil EATS platform offers clients the opportunity to make multiple orders, meaning that clients may place more than one (single) order at any restaurant located in Sambil Food Court.
- Once you place your order using Sambil EATS Platform and you realize that you have an error in the order, you have an max. of 60 seconds to call the restaurant to modify or cancel your order. After this time lapse the order cannot be canceled.
- Once you place an order at the Sambil EATS platform and you choose the delivery option, it is not possible to change the method to take-out even though you call the restaurant.
- Sambil EATS is not responsible for any unsealed food packages.
- Sambil EATS is not responsible for any allergies, injuries or food poisoning which may result in to sickness or death of any person.
- In case of unsatisfactory experience of any service related to Sambil EATS a claim must be made within 48 hours. Orders placed are not refundable. For any feedbacks or claims please contact Sambil EATS platform at sambileats@sambil.com or contact us at 735-3131.
3. Payments
- Only ANG (Antillean Guilders) is accepted and USD (American US Dollars) at 1.82 rate.
- Pick Up/ Take Out orders payments should be done at the restaurant counter.
- For Delivery: payments should be made to the delivery driver.
- Payments may be done by cash or swipe using a debit or credit card.
- Local loyalty cards are not accepted as payment method.
4. Restaurants
- The restaurant has a maximum of 15 minutes to prepare and have the order ready for delivery / take out. In the case of a multiple orders restaurants should maintain a maximum of 15 minutes to complete the order, so that the driver can pick up all the orders within the same time frame to be delivered to the client.
- Customers who order food from Sambil EATS will have priority access in the pickup line.
- Delayed order: each restaurant/food court outlet is responsible if the delivery order or pick up order is delayed. In this case the restaurant should call the customer and communicate this. Sambil EATS is not responsible for the delayed orders.
- The restaurants should seal the food packages.
5. Delivery
- There is no minimum amount required to place an order.
- Delivery hours will be the same hours as the shopping mall hours.
- Sambil EATS has arranged a special delivery price for our clients. The Delivery fee starts at NAF . 7, – all areas outside a radar of 9 kilometers NAF. 1, – will be added to the delivery price for every extra kilometer.
- In the case of multiple order at the same address, the delivery service company will only charge one delivery fee to the client (depending the km range). An additional service charge of NAF. 2,50 will be added to the delivery fee.
- The client can track the driver thru a link that will be sent to the email address provided.
- The Delivery Company will be able to deliver all around Curaçao.
- The delivery company can be identified by their car and/or Sambil Eats uniform.
- If the delivery company delivers a food package with a broken seal, please do not accept the order.

- Q: Can I order 24/7?
A: No, the delivery service is only available during mall opening hours. However you can order ahead and wait upon the delivery service at the scheduled time.
- Q: Is the delivery service available only for food, or beverages is also possible?
A: Yes, delivery service is available for every item on the menu.
- Q: What is the minimum amount to place an order?
A: There is no minimum amount.
- Q: If I order from more than 1 establishment, should I pay delivery costs for each?
A: The amount of NAF 2.50 service charge will be added to the original delivery fee.
- Q: Till what time is the delivery service available?
A: The same opening hours as the mall.
- Q: What is the estimate delivery time per order?
A: It depends; you can track your order by the delivery app.
- Q: What is the delivery area available?
A: We deliver all around Curaçao.
- Q: Do offer delivery for companies?
A: Yes.
ORDER:
- Q: Can I order from more than 1 establishment under one order?
A: Yes.
- Q: Till what time can I place my order?
A: Orders can be placed during opening hours, but you can order also in advance (a day in advance).
- Q: From what time can I place my order?
A: You can make order is advance, during opening hours, but you can order also in advance (a day in advance).
- Q: Is there a maximum I can order?
A: No.
- Q: If I place my order from the app, can I reserve my sitting area in the food court?
A: No.
- Q: Can I modify or cancel my order once its placed?
A: No.
TAKE OUT/CURBSIDE:
- Q: Is curbside service available?
A: Yes.
FOOD & BEVARAGE:
- Q: Will I receive my order warm and tasty?
A: Yes.
- Q: If I order a dessert is it guaranteed that it will be delivered in good order?
A: No.
- Q: Where should I report any problems or claim(s)?

PAYMENT:
- Q: What is the delivery fee?
A: The Delivery fee starts at NAF. 7,- after 9 kilometers NAF 1,- will be added to the delivery price for every extra kilometer.
For example: 11 km – NAF. 11 and 12 km – NAF. 12
- Q: What about payment and security?
A: Sambil EATS is not responsible for any monetary exchange that involves cash or any other mistake in the transaction process.
- Q: Which payment method is available? Is it secured?
A: You can pay in cash or swipe.
- Q: Is it possible to pay by online transfer?
A: No.
- Q: Will you accept debit/credit cards from all banks? Local & international?
A: Yes.
- Q: In case I pay cash, should I have the exact order amount, or will you have change available?
A: Yes, the driver will carry change if you prefer to pay in cash.
- Q: Will you accept payments by any local cards? Such as Funmiles, Fortuna cards etc.?
A: No, this payment method is not possible.
- Q: Can I pay in international currency? Such as USD $, Euro etc.?
A: Yes.
- Q: When I place an order, should I pay immediately, or do you offer credit line?
A: No, we do not offer credits, you need to pay immediately after making the order.

- Q: Do the prices on the menu include OB?
A: Yes, the prices include OB.
